General terms and conditions of business
Conclusion of contract
The paintings and art prints displayed in the online shop do not constitute a legally binding offer. By submitting the order, the customer makes a binding offer to purchase. The purchase agreement is only concluded when the seller expressly confirms the order or ships the goods.
Price
All prices are quoted in Swiss francs (CHF). Unless otherwise stated, the prices quoted do not include VAT, as C artwork is exempt from VAT as a small business. Shipping costs are shown separately and are to be borne by the customer. Please see our shipping costs page for more information.
Payment
The purchase price must be paid in full in advance. Order processing and shipment will only occur after successful receipt of payment. Currently, PayPal is the only accepted payment method. The goods remain the property of the seller until full payment is received.
Delivery and shipping
Shipping is handled by Swiss Post to the delivery address provided by the customer. Delivery is available to Switzerland, Germany, France, and Italy. Delivery times are estimates and may vary, particularly due to customs clearance or transport delays.
Retention of title
The delivered goods remain the property of the seller until full payment has been received.
Warranty
The statutory warranty provisions of Swiss law apply. The customer is obligated to inspect the delivered goods immediately upon receipt and to report any obvious defects in writing within a reasonable period.
Liability
The seller is liable for damages only within the scope of the statutory provisions. Liability for slight negligence is excluded to the extent permitted by law. Liability for intent and gross negligence remains unaffected.
Returns and cancellations
Since these are original paintings and high-quality art prints, returns and exchanges are generally not accepted.
Complaints will only be accepted if the goods were damaged during transport or if a demonstrably incorrect delivery was made. Damage in transit must be reported to the seller within 48 hours of receiving the goods, including photos of the damage and the packaging.
If a valid complaint is accepted and a replacement is not possible, the seller will, at their discretion, issue a full or reasonable partial refund of the purchase price or find another mutually agreeable solution.
Copyrights
With the purchase of an original painting or art print, the customer acquires sole ownership of the respective work. All copyrights, rights of use, reproduction, and publication remain with the artist, unless expressly agreed otherwise in writing.
Data protection
Personal data is processed exclusively in accordance with applicable data protection laws and is collected, processed, and stored only to the extent necessary for contract fulfillment. Further information can be found in the separate privacy policy.
